TERMS AND CONDITIONS OF THE RENTAL AGREEMENT
This document specifies the contractual rental conditions for technological products and services with AUTO123.
TECHNOLOGICAL RENTALS OF PRODUCTS AND SERVICES
Products, Advertizing and services rented from AUTO123 are made available for a period of one month from the date of their commissioning and are renewed monthly automatically unless the customer receives a cancellation request in writing.
Payments for the rental of products, advertizing and services are payable only through automated payment by credit card. The Customer may choose Visa or MasterCard as a method of payment.
In case of expiration of the said credit card, it is the responsibility of the Customer to notify us before the deadline.
No startup fee is required.
The logo of AUTO123 as well as that of the media network will appear in the footer of the site with a link to each of the sites.
Other services including but not limited to banner creation, photo shoots, window tags, tracking numbers, etc. are billed and payable on delivery. The hourly rate applicable in this case is $ 125 / hour.
Any cancellation request requires 30 days’ notice. The notice period starts on the first calendar day of the month following receipt by AUTO123. The notice must be submitted by email to auto123@dealercity.com.
DEFAULT OF PAYMENT
Any late payment of more than sixty (60) days (after the billing date) may result in the termination by AUTO123 of the rental agreement and the disconnection of products and services rented by the customer.
The Customer will have thirty (30) additional days after the disconnection of his website to correct the situation and pay any applicable fees to AUTO123.
AUTO123 disclaims all liability for loss or damage to the Customer or any third party resulting from the disconnection from our website as a result of a default.
INTEREST ON LATE PAYMENTS
Monthly interest of 2% will be charged to the Customer for late payments. These late fees are calculated and added on a monthly basis.
CUSTOMER RESPONSIBILITY
The Customer is responsible for the acquisition, configuration and maintenance of his computer equipment and its internet access software. The Customer is responsible for checking his website, his data and any other creative so as to identify, if necessary, any changes to make. Customer is responsible for communicating these changes directly to AUTO123 by email at support@AUTO123.COM. DISCHARGE OF RESPONIBILITY
AUTO123, its employees, representatives and agents shall not be liable to the Customer or any third party, whether in contract or in tort, for any direct, indirect, special or punitive damages, including but not limited to income, profits, intangible capital, data and other intangible assets, expenses for the recovery and replacement of goods and services, including lost data and damage to the Customer's computer system, even if AUTO123 had been advised of the possibility that such damage exists and (i) any delay in the use of the hosting and uploading services or inability to use them, or (ii) an invalid message recipient, transmission errors, unauthorized access authorized or loss / alteration of data. The Customer expressly acknowledges that AUTO123 is not liable to him for any damages, regardless of the cause, whether contractually or in tort, beyond the amount he has paid, and this, within the year where the services in dispute.
FORCE MAJEURE
None of the parties involved will be recognized as being in breach of their obligations if a force majeure delays, coerces or prevents the said obligations. RIGHT OF TRANSFER OF CONTRACT
AUTO123 reserves the right to assign all or part of this contract and any other contract between the parties (AUTO123 and the customer).
